On Friday afternoon, the City responded to Open Records Requests (ORRs) I filed earlier in the week asking for new information for the second go-round of RZ-22-007, a request to rezone a little over two acres of property at the corner of Highway 20 and Sugar Ridge Drive to build a commercial complex.
The City Council denied the request in May 2023 and the developer immediately sued the City. Gwinnett Superior Court issued an order in October remanding the case to the City of Sugar Hill for reconsideration.
The last time the case was considered, the developer had agreed to limit the buildings to no more than two stories, build only one building, not use the property for a restaurant, and withdraw his variance request.
The site plan most recently submitted by the developer and the new list of recommended conditions in the updated Planning Department report indicate that these conditions are still on the table, although the City Council will have the final say regarding any conditions when they vote on the rezoning at their December meeting.
The Sugar Hill Planning Commission will conduct a public hearing and vote on whether to recommend approval of the rezoning at their November meeting on Monday, November 20 at 7:00 PM at City Hall.
